Terms of Service
Effective 25 August 2026.
These Terms govern the use of fuelup, including the public car, the leaderboard, sponsor pages, and checkout. By using the site, submitting a listing, or completing a payment, you agree to these Terms and to the Privacy Policy. If you do not agree, do not pay.
Who operates this
fuelup is operated by Kevin Baur, BSc, Hochstraß 542, 3033 Klausen-Leopoldsdorf, Austria. VAT ID ATU82351615. Contact: fuelup@kevin-baur.com. Full details are in the imprint.
These Terms sit alongside the public Rules. Where the two conflict, these Terms apply.
What the service is
fuelup sells time and visibility on a page we operate. Listings are paid placements. They are not reviews, endorsements, certifications, or an independent ranking of quality. A listing says one thing: this sponsor paid.
A payment buys the driving time and the kilometers described in the Rules, at the position in the queue that exists when your order is approved. It does not buy traffic, clicks, customers, revenue, search rankings, a particular moment of the day, or any other outcome. We may change, pause, or retire features, including the queue, the cap per order, and the way ranks are calculated.
Who may use it
- You must be at least 18 and able to enter into a binding contract.
- If you are acting for a company, you confirm that you may bind that company, and "you" includes it.
- You may not use the service if sanctions or other law prevent us from providing it to you.
Payment
Checkout is handled by Whop, which acts as merchant of record. We never see or store card numbers. Whop's own terms apply to the payment itself. Prices are in US dollars and tax may be added at checkout.
Completing checkout is an offer to buy driving time on these terms. The order is recorded as pending, reviewed by hand, and scheduled when approved.
No refunds
Payments are final. The service begins as soon as the order is approved: the amount is added to the odometer and to your all-time rank, and a window is reserved for you. Fewer visitors than you hoped for, a time of day you did not choose, downtime, or later removal for breach of these Terms do not create a refund.
By completing checkout you ask us to begin immediately and accept that any statutory right of withdrawal ends once we do, to the extent the law allows that. Where a consumer right cannot be waived, it still applies. Chargebacks without a legal basis are a breach of these Terms; we may remove the listing and refuse future orders.
Your site must say who runs it
You may only list an address you own or are authorized to represent. The site you link to must show valid, current details identifying who is legally responsible for it: the legal name and, where the law applying to that site requires it, a postal address, a working contact method, and any further imprint or registration information. Missing, false, or unverifiable details are grounds for removal without refund.
What you promise us
- You may list that destination and send visitors to it.
- The listing and the destination comply with applicable law, including advertising, consumer, privacy and intellectual property rules.
- You are not impersonating anyone and are not listing a competitor's site without authorization.
- The destination is not malware, phishing, or built to deceive its visitors.
- What you submit is accurate.
What may not be listed
- Sexual or adult content; chat, invite or messaging-group links; link shorteners used to hide the real destination.
- Anything illegal, fraudulent, defamatory, harassing, hateful or violent, or that exploits children.
- Counterfeit goods or other infringement of copyright, trademark, or comparable rights.
- Offers requiring a license you do not hold, including certain financial, medical, gambling and weapons-related offers.
- Interfering with the service: scraping beyond ordinary use, bypassing rate limits, automated ordering without written permission, or reverse engineering except where mandatory law allows it.
We may remove listings
We may refuse, delay, edit, hide, or permanently remove any listing, with or without notice, where we believe these Terms, the Rules, or the law may have been broken, where a rights holder complains, where the operator details on the destination are missing or invalid, or where a listing creates legal, security, or reputational risk. Removal does not create a refund.
Logos, names and trademarks
To run the car we fetch and display publicly available material from the address you submit: the name, the description you give us, the logo or favicon, and the colors we read out of that logo. We use it only to identify the sponsor on this site and to show visitors where a paid placement leads.
This is intended as use of a sign to identify the goods or services being listed, and, where United States law applies, as nominative fair use of trademarks and fair use of copyrighted material. We use no more than is needed to identify the destination, we do not adopt it as our own brand, and we do not suggest that the rights holder endorses us. If you are a rights holder and want material removed, write to fuelup@kevin-baur.com.
The name fuelup, the car, and the design of this site are ours. Do not copy the site, scrape the leaderboard for a competing product, or use our name in a way that suggests we endorse you. Whop, Cloudflare and other third-party names belong to their owners.
The license you give us
You grant us a worldwide, non-exclusive, royalty-free license to host, cache, resize, and publicly display your listing and the public material we fetch, for as long as needed to operate the service and keep its history. To take a listing down, write to fuelup@kevin-baur.com. A takedown does not undo a completed payment.
Complaints
If you believe a listing infringes your rights or points somewhere unlawful, write to fuelup@kevin-baur.com with your name and contact details, the sponsor page on this site, the destination address, a description of the problem, and confirmation that you are the rights holder or may act for them. We may restrict the listing while we look at it, and may pass the notice to the sponsor.
No endorsement, no promises about results
Appearing on the car is not our opinion of anyone. We do not verify that a sponsor's claims, prices, or products are accurate. Kilometers, ranks and times describe what was paid, not what it achieved. Links leave this site; what happens on the other side is not ours to control.
Availability and changes
The service is provided as it is. It may be unavailable, slow, or wrong. We may change the rules, the minimum, the cap, or these Terms; if a change matters, we update the date at the top of this page. For a payment already completed, the Terms in force at checkout continue to apply to it, except where the law or a security risk requires otherwise.
Disclaimer
To the fullest extent the law permits, we exclude all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service is uninterrupted or error-free, or that names, images, colors, ranks or times are accurate.
Liability
We are liable without limit for intent and gross negligence, for injury to life, body or health, and wherever mandatory law does not allow a limitation. That includes the Austrian Product Liability Act (Produkthaftungsgesetz). Beyond that:
- Liability for slight negligence is excluded towards businesses. Towards consumers it is excluded only to the extent Austrian consumer protection law permits.
- We are not liable for lost profit, lost data, lost goodwill, or other indirect or consequential damage.
- Our total liability for a claim connected to a payment is limited to the amount you paid for the listing that claim concerns.
Indemnity
You will indemnify Kevin Baur against claims, damages, losses and reasonable legal costs arising from your listing, your destination, your payment or chargeback, your breach of these Terms, or your infringement of someone else's rights.
Governing law
These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, mandatory consumer protection law of your country of residence still protects you, and you may also sue at the court of your place of residence. For businesses, the court with subject-matter jurisdiction at our seat has exclusive jurisdiction.
General
- If part of these Terms is unenforceable, the rest stays in force.
- Not enforcing a provision is not a waiver of it.
- You may not transfer these Terms without our consent; we may transfer them together with the service.
- These Terms, the Rules and the Privacy Policy are the whole agreement about the service.
